In order to obtain legal protection for a trademark, it is necessary to register the design thereof in a patent office of our choice (e.g. in Poland it’s the Polish Patent Office, which we choose if we want to protect the brand in Poland). The protection of a trademark starts immediately upon applying. The benefits of having a registered trademark probably do not need to be explained to the reader of this article; however, it is essential to remember that only a registered trademark enables its owner to enforce the rights associated with its ownership.

At the same time, one must be aware of the fact that the process of securing a brand and the trademark registration itself involves the necessity of paying official fees (that is, patent office fees).

First and foremost, it should be emphasized that the cost of a trademark may vary depending on the:

number of classes for which the application is made;
chosen territorial scope of protection (Poland, European Union, selected countries worldwide);
type of trademark (whether a logo or a name is to be protected).

COSTS OF TRADEMARK REGISTRATION IN POLAND IN 2023

When it comes to brand protection in Poland, an application must be filed with the Polish Patent Office. The application is examined by an expert, and if no obstacles are found, a 3-month opposition period begins (a period during which any member of the public who thinks they’ll be harmed by the registration of your trademark may oppose it). What’s important – the protection of the trademark right is effective from the date of application.

COST OF APPLICATION – fees to be paid at the time of submitting the trademark application to the Polish Patent Office:

Fee for filing a trademark application in one trademark class: PLN 450.00;
Fee for filing a trademark application for each subsequent trademark class: PLN 120.00.

COST OF PROTECTION – fees to be paid after approximately 5-6 months from the date of submitting the trademark application to the Polish Patent Office:

Fee for a 10-year protection period for each trademark class: PLN 400.00;
Fee for publishing information about the granted right of protection: PLN 90.00.

For example, the total official cost for registering a trademark in three classes would be as follows:

Application:

Fee for filing in one class: PLN 450.00;
Fee for filing for each subsequent class: PLN 240.00 (PLN 120.00 + PLN 120.00);
Total: PLN 690.00.

Protection:

Fee for a 10-year period for each class of goods: PLN 1200.00 (PLN 400.00 + PLN 400.00 + PLN 400.00);
Fee for publishing information about the granted right of protection: PLN 90.00;
Total: PLN 1290.00.

COSTS OF TRADEMARK REGISTRATION IN THE EUROPEAN UNION IN 2023

If a trademark is to be protected throughout the European Union, the trademark registration must be carried out at the European Union Intellectual Property Office [ ]. In this case, the process of securing the brand, unless any obstacles arise, should take about 6 months and result in a successful trademark registration.

Unlike the costs paid to the patent office in Poland, in this case, a one-time payment is made to the EUIPO at the time of applying for the trademark registration. After successfully completing the process, the intellectual property office will send us a registration certificate confirming the granting of trademark rights to the registered trademark.

COSTS OF TRADEMARK REGISTRATION IN THE EU (APPLICATION AND PROTECTION)

Basic fee for filing an individual EU trademark: 1000 EUR;
Basic fee for filing an individual EU trademark through electronic means: 850 EUR;
Fee for the second class of goods and services for an individual EU trademark: 50 EUR;
Fee for each class of goods and services beyond the second class for an individual EU trademark: 150 EUR.

For example, if we submit the trademark application electronically for a trademark in three classes, the total official cost (cost of trademark registration) would be as follows:

Basic fee: 850 EUR;
Fee for the second class of goods and services: 50 EUR;
Fee for three or more classes: 150 EUR;
Total: 1050 EUR.

COSTS OF TRADEMARK REGISTRATION IN SELECTED COUNTRIES WORLDWIDE IN 2023

In order to register a trademark in a third country (as opposed to Poland and other EU countries) through the international procedure, it is necessary to first register the trademark in Poland or the European Union. By doing so, the scope of protection can be extended to the desired international jurisdictions.

Applications must be filed with the World Intellectual Property Organization [WIPO]. In this case (similar to filing within the EU’s EUIPO) an official fee is paid only once, so the overall cost of trademark registration is similar to the above, and the trademark itself will be protected worldwide.

COST OF APPLICATION AND PROTECTION (e.g. for the United States):

Basic fee for filing a trademark application in one class: If the trademark is not presented in colors: 653.00 CHF; If the trademark is presented in colors: 903.00 CHF.
Fee for designating the country (in our case, the United States): 460.00 CHF.

The official fee for filing for trademark registration may vary depending on the chosen country.

For example, for a word trademark (e.g. company’s name) registered with the patent office in Poland in three classes and subsequently filed in three countries: the United Kingdom, the USA, and Canada, the official fees would be:

Basic fee for filing in one class: 653.00 CHF;
Fee for designating the registration countries: 2126.00 CHF;
Total: 2779.00 CHF.

Trademark applications in selected countries can also be made through a local representative. In this case, the application is submitted directly to the relevant national patent office.

Fee for filing a trademark application in one trademark class: 105 EUR (approx. 475.00 PLN);

Additional fee for filing a trademark application in color: 25.00 EUR (approx. 113.00 PLN).

Cost of trademark registration in China:

Fee for filing a trademark application in one trademark class: 300.00 RMB (approx. 180.00 PLN);
Fee for filing a trademark application for each subsequent trademark class: 300.00 RMB (approx. 180.00 PLN);
Fee for additional goods/services in each class: 30.00 RMB (approx. 18.00 PLN).

Cost of trademark registration in the United Kingdom:

Fee for filing a trademark application in one trademark class: 200.00 GBP (approx. 1040.00 PLN);
Fee for filing a trademark application for each subsequent trademark class: 50.00 GBP (approx. 260.00 PLN).

Cost of trademark registration in Canada:

Fee for filing a trademark application in one trademark class: 347.35 CAD (approx. 1071.00 PLN);
Fee for filing a trademark application for each subsequent trademark class: 105.26 CAD (approx. 325.00 PLN).

Cost of trademark registration in Norway:

Fee for filing a trademark application in one trademark class: 2900.00 NOK (approx. 1100.00 PLN);
Fee for filing a trademark application for each subsequent trademark class: 750.00 NOK (approx. 291.00 PLN).

Cost of trademark registration in Australia:

Fee for filing a trademark application in one trademark class: 250.00 AUD (approx. 690.00 PLN);
Fee for filing a trademark application for each subsequent trademark class: 250.00 AUD (approx. 690.00 PLN).

Cost of trademark registration in New Zealand:

Fee for filing a trademark application in one trademark class: 100.00 NZD (approx. 260.00 PLN);
Fee for filing a trademark application for each subsequent trademark class: 100.00 NZD (approx. 260.00 PLN).

Cost of trademark registration in the United States:

Fee for filing a trademark application in one trademark class: 350.00 USD (approx. 1475.56 PLN);
Fee for filing a trademark application for each subsequent trademark class: 350.00 USD (approx. 1475.56 PLN).

Cost of trademark registration in the United Arab Emirates:

Fee for filing a trademark application in one trademark class: 219.00 USD (approx. 924.00 PLN);
Fee for publishing the trademark: 335.00 USD (approx. 1413.00 PLN);
Fee for registering the trademark: 1145.00 USD (approx. 4830.00 PLN).
